Terms of Service

1. Eligibility

You must be at least 13 years old to use the free version of the Service, and at least 18 years old to purchase a paid subscription or enter into binding agreements with us. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

MealForm is an AI-powered cooking companion. The Service includes recipe recommendations, voice-guided cooking, visual feedback, taste profiling, and related features. We're actively developing the Service; features may change, be added, or be removed.

The Test Kitchen is a private beta program. Access is granted in batches at our discretion. Beta features may behave differently than described.

3. Your account

You're responsible for keeping your account secure (password, device access) and for everything that happens under your account. Provide accurate information when you sign up and keep it current. Notify us promptly at admin@mealform.ai if you suspect unauthorized use.

4. Subscriptions and billing

• Tiers: the free tier is Taste. Paid tiers are Flavor Pro ($5.99/month) and Palate Prime ($12.99/month). Current pricing is shown in-app at the time of purchase and may change with reasonable notice for new billing periods.
• Billing: subscriptions auto-renew at the end of each billing period unless cancelled.
• Cancellation: you can cancel anytime through your app store or account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: payments are generally non-refundable except where required by law or as described by the platform (Apple App Store, Google Play) you purchased through.
• Test Kitchen: access to the Test Kitchen is free during the private beta. We may begin charging for some or all features at the end of the beta with reasonable advance notice.

5. Your content

You retain ownership of content you create or upload through the Service (recipes, modifications, ratings, dish photos, voice recordings, prompts to DALA).

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content as needed to operate, maintain, and improve the Service for you. This license ends when you delete the content or your account, except as needed for backup retention or as required by law.

If you choose to share your Flavorprint, taste signature, or any other content publicly through Service features designed for sharing, you grant other users a limited right to view that shared content.

6. Captured voice content (Capture with Dala)

Voice recordings you capture through the Capture with Dala feature have special protections beyond ordinary user content. These are commitments, not aspirations:

• No cloning or synthesis. We do not create AI voice clones or synthetic models from your captured recordings. Playback uses the actual audio you recorded.
• No model training. We do not use captured voices to train AI models, ours or any third party's.
• Lifetime preservation. For as long as MealForm operates and your account is active, we preserve your captured recordings in their original audio format.
• Locked recipes. Recipes captured through Capture with Dala are preserved as recorded. No flavor rebalancing, no substitution suggestions, no AI-generated modifications. Heirlooms are not edited.
• Wind-down plan. If MealForm is acquired or discontinued, we will provide reasonable notice and the ability to export your captured recordings in their original audio format.

You retain ownership of captured recordings. You can delete them at any time; deletion is permanent.

You are responsible for capture consent. Only record people who have knowingly agreed to be recorded. Do not upload voice recordings of any person without their informed consent.

7. AI and cooking-safety disclaimers

The Service uses AI to recommend recipes, narrate cooking steps, identify dishes, and provide cooking guidance. AI output may be inaccurate, incomplete, or unsuitable for your situation.

You are responsible for your own cooking safety, including but not limited to:

• Allergen awareness and ingredient verification
• Food handling, hygiene, storage, and cross-contamination
• Internal cooking temperatures, doneness, and food-borne illness risk
• Equipment safety (sharp objects, heat, electrical, gas, pressure)
• Nutritional appropriateness for your diet, medical conditions, or medications
• Compatibility with religious, ethical, or cultural dietary restrictions

The Service is not a substitute for medical, dietary, or professional culinary advice. Always consult appropriate professionals for medical, dietary, or specialized cooking concerns.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to disrupt, reverse-engineer, decompile, or gain unauthorized access to the Service
• Submit content that infringes others' rights, is harmful, illegal, or violates these Terms
• Scrape, harvest, or otherwise extract data from the Service without our permission
• Use the Service to develop a competing product or service
• Impersonate others or misrepresent your identity
• Upload voice recordings of any person without their informed consent
• Bypass rate limits, quotas, or other technical restrictions

We reserve the right to suspend or terminate accounts that violate these terms.

9. Intellectual property

The MealForm name, brand, software, content, and design are owned by MealForm LLC (or licensed to us). You may not copy, modify, distribute, or create derivative works of our intellectual property without written permission.

10. Termination

You can stop using and delete your account at any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or for legal or operational reasons. On termination, your access ends. We may retain limited information as described in our Privacy Policy.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

12. Limitation of liability

To the maximum extent permitted by law, MealForm LLC and its members, employees, and contractors are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including loss of data, lost profits, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars ($100).

Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, willful misconduct, or gross negligence).

13. Indemnification

You agree to indemnify and hold MealForm LLC harmless from claims, damages, losses, and reasonable expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, your content, or your violation of others' rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state and federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.

If you live in the EU, UK, or another jurisdiction with consumer-protection laws that confer additional rights, those rights are not overridden by these Terms.

15. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here with an updated "Last updated" date. Significant changes will be communicated with reasonable advance notice (in-app message or email). Continued use after the changes take effect means you accept them.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

17. Entire agreement

These Terms (together with our Privacy Policy) constitute the entire agreement between you and MealForm LLC regarding the Service and supersede prior agreements on the same subject.
